This Privacy Policy applies to Tundra Technical Solutions Inc. and its affiliated entities operating under the Tundra brand (collectively, “Tundra”). It describes Tundra’s practices for collecting, using, and disclosing Personal Information. Tundra Technical Solutions Inc., located at 4711 Yonge Street, Suite 700, Toronto, Ontario, M2N 6K8, is the accountable organization for purposes of applicable Canadian privacy law. A current list of affiliated entities covered by this Privacy Policy is available upon request from the Group Privacy Officer.
Tundra assists temporary and permanent worker candidates (the “Candidates”) to find and fulfill temporary and permanent jobs for our clients (the “Clients”). Tundra also provides managed solutions services. If a Candidate chooses to create an account and profile on the Tundra Website, Tundra collects the Candidate’s login information to provide access to that profile. Tundra uses the Personal Information the Candidate provides for the purposes of matching the Candidate with positions on behalf of Clients. Tundra may disclose relevant Personal Information to Clients for that purpose. Tundra also collects additional information when a Candidate applies to jobs, interviews with Tundra, provides references, or works on assignments with Clients. Clients may retain and use information they receive in accordance with their own privacy practices and applicable law.
This Privacy Policy should be read in conjunction with Tundra’s Terms of Use and, where applicable, any other agreement you have with Tundra.
As used herein, “Personal Information” means any information recorded in any form about an identifiable individual, or an individual whose identity may be determined from the information, and may include information such as a person’s name, IP address, email address, residential address, telephone number, and, in some cases, more sensitive information such as educational history, employment history, government-issued identification numbers, background checks, reference checks, and financial or tax information. Certain categories of information collected by Tundra may constitute “Sensitive Personal Information” under applicable law, including under the California Consumer Privacy Act, as amended.
You provide Tundra with much of the data we collect. Tundra collects and processes Personal Information directly from you when you use the Tundra Website or engage with Tundra’s Services. Tundra may also obtain Personal Information about you from third parties, including clients, service providers, references, and publicly available sources, as permitted by applicable law. Tundra uses and discloses Personal Information only as described in this Privacy Policy and as otherwise permitted or required by law.
Tundra may disclose Personal Information to its affiliates for the purposes set out in this Privacy Policy.
To the extent you provide Personal Information about others (including Personal Information of your clients, third parties, or third-party job candidates), you represent and warrant that you have obtained all necessary consents or other legal authority to disclose such Personal Information to Tundra and to allow Tundra to process such Personal Information in accordance with this Privacy Policy.
You may opt out of any marketing communications from Tundra and its affiliates at any time. Tundra’s emails will contain instructions for removal from any mailing list. This Personal Information will form part of a Candidate’s profile and will be disclosed to the Client to provide the Services. The Client will handle such Personal Information in accordance with its own privacy practices and applicable law. If Tundra’s relationship with the Client is terminated, the Client may retain the Candidate’s Personal Information for the purpose of fulfilling temporary and permanent work assignments.
Tundra may also require financial, accounting, payroll, tax, and employment-related information to provide the Services and comply with legal, regulatory, and contractual obligations.
Tundra may use your name and email address to send service-related communications, including account information, updates, and notifications relating to the Services. Where permitted by applicable law, Tundra may also send information about Tundra’s or its affiliates’ services.
Retention of Personal Information. Tundra retains Personal Information for the following periods, or as otherwise required by applicable law:
Tundra may use login information and IP addresses to help diagnose problems, administer the Tundra Website, maintain security, and understand general website usage. Tundra may use cookies or similar technologies to support website functionality and analytics.
Tundra may disclose Personal Information to service providers and other organizations that perform services on its behalf, as permitted by applicable law.
It is your responsibility to keep your credentials to access the Tundra Website safe. You agree to notify us as soon as possible if you become aware of any misuse of your password and to immediately change your password.
Tundra limits access to Personal Information to employees, contractors, and agents who need that information to provide the Services. Those recipients are subject to confidentiality obligations. Employees may be disciplined or terminated if they fail to meet these obligations.
The Internet is not inherently secure, and Tundra cannot guarantee that your Personal Information will be secure at all times. Transmission of Personal Information over the Internet is at your own risk, and you should only submit Personal Information to the Tundra Website within a secure environment.
Subject to applicable law, you may have the right to request access to, correction of, or deletion of your Personal Information.
Access. You may request access to the Personal Information Tundra has collected about you. Tundra will provide access at no charge, except where a fee is permitted by applicable law.
Correction. You may request that Tundra correct inaccurate Personal Information maintained about you.
Deletion. You may request that Tundra delete your Personal Information, subject to applicable legal and operational exceptions.

This Section 5.1 applies only to California residents and describes rights provided under the California Consumer Privacy Act, as amended. It applies to Personal Information collected by any Tundra Group entity.
In the preceding twelve (12) months, Tundra has collected the following categories of Personal Information: identifiers, professional or employment-related information, education information, financial information, internet or other electronic network activity information, inferences drawn from Personal Information, and Sensitive Personal Information, including government-issued identifiers and financial account information.
Tundra collects Personal Information directly from you, from your use of the Tundra Website, from clients and business partners involved in staffing and workforce solutions, and from service providers and other third parties that support Tundra’s operations. Tundra uses this information to provide staffing, recruiting, employment, payroll, accounting, compliance, and related business operations.
Tundra does not sell Personal Information and does not share Personal Information for cross-context behavioral advertising.
Tundra may disclose Personal Information to clients, affiliates, and service providers as necessary to provide staffing, recruiting, payroll, accounting, compliance, website support, and related business operations.
Tundra does not use or disclose Sensitive Personal Information for purposes other than those permitted by applicable law.
California residents have the right to request that Tundra disclose the categories and specific pieces of Personal Information Tundra has collected about them, the categories of sources from which the information was collected, the business or commercial purposes for collecting, using, or disclosing the information, and the categories of third parties to whom the information was disclosed.
California residents also have the right to request deletion of Personal Information collected from them and correction of inaccurate Personal Information, subject to exceptions permitted by law.
Tundra will not discriminate against you for exercising any rights available to you under California law.
You may designate an authorized agent to submit a request on your behalf. Tundra may require the agent to provide written authorization and may require you to verify your identity directly with Tundra.

This Section 5.2 applies to Quebec residents and supplements the rest of this Privacy Policy. It reflects Tundra’s obligations under the Act respecting the protection of personal information in the private sector, as amended by Act 25 (“Law 25”).
Privacy Officer. Tundra’s Group Privacy Officer (identified in Section 5 above) is responsible for the protection of Personal Information held by the Tundra Group. You may contact the Group Privacy Officer at any time with questions or concerns about this Privacy Policy or Tundra’s privacy practices.
Your Rights. Quebec residents have the right to (a) access the Personal Information Tundra holds about them; (b) request correction of inaccurate, incomplete, or ambiguous Personal Information; (c) request deletion of Personal Information collected, communicated, or used contrary to law; (d) be informed of and, where applicable, object to the use of Personal Information for profiling or automated decision-making that produces legal or significant effects; and (e) receive Personal Information in a structured, commonly used technological format (data portability). Cross-Border Transfers. Tundra Group entities operate in multiple jurisdictions. Your Personal Information may be transferred to, and processed by, Tundra Group entities or third-party service providers located in provinces or countries outside Quebec, including Ontario and the United States. Transfers among Tundra Group entities are intragroup transfers governed by this Privacy Policy. Before communicating Personal Information outside Quebec to any recipient, Tundra conducts a privacy impact assessment as required by Law 25. Complaints. If you have a complaint about Tundra’s handling of your Personal Information, you may contact the Group Privacy Officer. If the matter is not resolved to your satisfaction, you may file a complaint with the Commission d’accès à l’information (CAI) at www.cai.gouv.qc.ca.
Artificial Intelligence. Tundra may use artificial intelligence (AI) tools to assist its recruiting and placement activities; all hiring and placement decisions are made by a human.
This Section 5.3 applies to individuals located in the European Union or European Economic Area (“EU/EEA”) whose Personal Information is processed by a Tundra Group entity. It supplements the rest of this Privacy Policy and reflects Tundra’s obligations under Regulation (EU) 2016/679 (the “GDPR”). In the event of any conflict between this Section 5.3 and other sections of this Privacy Policy as applied to EU/EEA data subjects, this Section 5.3 prevails.

Tundra Group entities operate in multiple jurisdictions. Your Personal Information may be transferred to, and processed by, Tundra Group entities or third-party service providers located outside the EU/EEA, including in Canada and the United States.
Transfers from the EU/EEA to Canada are made on the basis of the European Commission’s adequacy decision for Canada under the Personal Information Protection and Electronic Documents Act (PIPEDA). Transfers to the United States are made on the basis of Standard Contractual Clauses approved by the European Commission pursuant to Article 46(2)(c) GDPR, or such other transfer mechanism as may be applicable.
Transfers from the United Kingdom are governed by the UK GDPR and made on the basis of International Data Transfer Agreements or other transfer mechanisms approved by the UK Information Commissioner’s Office, as applicable.
Tundra retains Personal Information of EU/EEA data subjects for the following periods or criteria:
Retention periods are reviewed periodically. At the end of the applicable retention period, Personal Information will be securely deleted or anonymized.
If you believe that Tundra has not complied with its obligations under the GDPR in respect of your Personal Information, you have the right to lodge a complaint with the supervisory authority in the EU/EEA member state of your habitual residence, place of work, or the place of the alleged infringement.
